My Health My Data Policy
In compliance with the Washington Consumer Health Data Privacy Policy Act, also known as the "My Health My Data Act."
If you decide to solicit advice from Smart is not Easy, LLC, you may choose to share various data, including health data, about your family and/or your children with Smart is not Easy, LLC. Because Smart is not Easy, LLC is not a medical provider, your health data is not covered by HIPAA (Health Insurance Portability and Accountability Act). However, in Washington state, non-medical providers are now required to follow the new My Health My Data Act to disclose how your health data will be collected, shared, stored, and used. All scheduled meetings with Smart is not Easy, LLC require your signed consent of the Hold Harmless Agreement, which includes a link to this My Health My Data Policy.
Any health data that you choose to share is very helpful to enable Smart is not Easy, LLC to better understand your unique situation, however providing this data is optional and at your discretion. Health data may include, but is not limited to:
- Evaluation reports from neuropsychologists, psychologists, educational therapists, counselors, doctors, or other professionals
- Test scores, reports, 504 Plans, Individual Education Plans (IEPs), etc. from schools or other educational institutions
- Medical records
- Student work samples
- Narrative descriptions of student strengths, challenges, medical history, education history, social history, emotional history, etc.
You may provide this data via email, text message, phone, online meeting, in person, or other means, whether oral, written, or electronic. Any information or files that you provide are stored in email, in a folder on my computer, or in a folder in a locked file cabinet. Smart is not Easy, LLC also takes notes on paper during our meetings and keeps those notes in a locked file cabinet. Smart is not Easy, LLC may consult your data prior to a consultation meeting to prepare, during our meetings to inform our conversation, as well as when composing notes following a meeting or during any other followup communications. Smart is not Easy, LLC also keeps aggregate notes about various professionals, schools, and other resources based on anonymized client feedback. Smart is not Easy, LLC does not share any information that you provide with any third party.
If you wish to delete the information that Smart is not Easy, LLC has stored about you, you can email austina@smartisnoteasy.com to make that request at any time. Smart is not Easy, LLC will confirm your request by return email; please ensure you get a confirmation to be sure your message was received. By law, data must be deleted within 45 days of making a request. Paper records will be shredded and electronic records will be permanently deleted.
